New Jersey Arrested & Convicted Dustin
In August 2010 New Jersey convicted Dustin with out him being present for jury trial, for moving from Maine back to his home State of Texas for having his Legally Owned Personal Firearm Collection. They convicted him without him being present for up to 38 Years, which is considered a lifetime sentence in New Jersey, for the following Charges: A Rifle (Dustin’s Fathers Child Hood Hunting Rifle), Shotgun (Dustin’s Grand Father’s Shotgun), Ammunition (which New Jersey allows and one can purchase at any Outdoor Store), Magazines (that are legal in all States), and Hindering (because Dustin was sleeping and would not grant the Police a Consent Voluntary Search). They offered him 90 days in Jail and 4 Felony Convictions if he Pleaded Guilty. Dustin refused the Plea Bargain feeling he would be released based upon Federal Law and his Constitutional Rights but he was convicted anyway. Dustin has lost Custody of his Kids, Job and Career, House, Vehicles, Community Volunteer Positions, and his Parents have had a Heart Attack and Stroke. Dustin's Ex-Wife even used it as a Tactical Advantage to keep his Kids from him. He has lost more in just a few month period of time than he could have lost from being in Prison for 3 months for the Plea Bargain to 38 years maximum. All for feeling that it was his right to move with his Firearms under the Federal Laws and Constitutional Amendments.

New Jersey Violates Dustin’s Rights While Moving
While going thru a High Drama Divorce & Child Custody Battle that Dustin had filed for a year prior in 2008, Dustin was moving his last load of house hold goods from the State of Maine back to his home State of Texas. Little did Dustin know that the next 24 hours would change his life and his legal belief system forever. During the early morning hours of March 20, 2009 Dustin was falling asleep at the wheel of his vehicle and for his and others safety decided to pull off the Interstate Highway into a small town in New Jersey just minutes away from Pennsylvania. Dustin telephoned his parents in Texas whom were worried for him because he had no sleep in days and they were excited he was seeking a place to stop off and sleep for at least a few hours. Dustin found a nice well lighted parking lot by a Bank and Gas Station where he could top off with fuel in the morning. Dustin had moved his belongings all the way up to Maine from Texas just years prior in 2005 and had already moved the majority of his belongings back to Texas so he considered himself an experienced mover where he had often sought sleeping refuge in Bank and Church Parking Lots many times in many different States during his moving adventures. He considered these parking lots to be the safest ones as these would contain the least amount of Criminal Activity and where Police Patrolled. He had been awaken before during his other loads in large moving trucks by Police and even Curious Church Members on one occasion. On all occasions Dustin was pleased to introduce himself and to have the individuals feel more comfortable about him being there and his intentions of just getting rest. After this particular incident made the News many people had comments about Dustin parking in a Bank Parking Lot. Consider the fact that the Bank Parking Lot being well lighted is actually a pretty safe place to park. Consider also the fact that there is more Criminal Activity that occurs in an Interstate Rest Stop and Hotel Parking Lots than any other parking areas. When it’s early morning hours Church and Bank Parking Lots are far easier to locate and safer than anywhere else. In addition it makes sense for a person moving their valuables to just stop and get some rest when they are becoming a danger and sleep in their own vehicle so they can protect their property from Criminal Activity. Getting a hotel room for over $150 just to get 4 hours of sleep just doesn’t make sense. Also Dustin had been living out of his Vehicle when he would fly up to Maine several times a month for Divorce Court and Visits with his Daughter for the same reason as the Hotel Rooms were just too expensive. There is no difference between Dustin living in his Vehicle and someone else living in their Travel Trailer. There were bags of Food, Clothing, and Blankets proving he had been living out of his vehicle. He also had house hold property he was moving with.
As Dustin had been sleeping, a Police Officer with Readington Township, New Jersey Police walked around his vehicle attempting to look in thru the Blacked Out Windows and woke Dustin up, and asked the common questions. Dustin was still so sleepy that he was having problems being able to distinguish finding the vehicle’s Insurance and Registration Forms from Oil Changes and other Documents as Dustin was still mostly asleep. The Officer never told Dustin why he was questioning Him. When Dustin asked the Officer if he needed to move and sleep else where, the Officer told him he could stay but may have to move later on when the Bank opened. But the Officer still did not tell Dustin why he was asking him questions and never told Dustin he did anything wrong. Dustin had been so tired that he continued to fall alseep. The Officer removed Dustin from the vehicle stating in the Video that he saw a Firearm Case in the rear of the vehicle that looks like a case he owned at home for his Firearm. The Case the Officer was seeing was a Duffle Bag made out of Nylon Material and was not a Firearm Case. But the Officer did not see this bag until he looked inside of Dustin’s vehicle while Dustin had his window open, as the windows were Blacked Out. This is when the Officer contacted his dispatcher via radio to let them know he had a vehicle with a firearm when in actuality it was just a Nylon Duffle Bag. During an evidence hearing that next year in 2010 the police officer stated that all of the Firearms where cased when they removed them from the vehicle. The Officer testified during the Evidence Hearing that he Profiled the Vehicle because of the Texas License Plates stating that since People in Texas are Pro-Gun that there had to be Guns in the vehicle. The Officer also said in the Video 2 times during a conversation with fellow officers, that he knew the vehicle had guns because of the Texas License Plates. So during those early morning hours of March 20, 2009 when the Officer’s backup Officer arrived on scene, the Arresting Officer removed Dustin from his vehicle and started to search the vehicle without a consent search. A few minutes later the Officer was trying to get Dustin to admit he was still an Employed Police Officer, which he was not because he was in between Law Enforcement positions and moving, and Dustin was not going to lie because they could charge him for impersonating a police officer. The Officers continued to ask Dustin for his Police Identification, Dustin kept stating that he was not currently employed as a Police Officer and that he was in between Law Enforcement Positions. The Officers asked Dustin if they could search his vehicle and Dustin told them No. The Officer told Dustin that he was getting close to being Arrested for Hindering suggesting that Dustin either gives them Consent to Search or be arrested for Hindering. The Officers continued to search the vehicle where they developed a pattern of conducting their Search where they removed things out of the vehicle onto the ground, then Stopping to ask Dustin for his Consent to Search. Dustin continued to tell them No, not giving them the Consent Search. The Officers continued this pattern several more times when they finally hand cuffed Dustin telling him he was not under arrest yet and still tried to get his consent search. On the video you can hear the Officer mention hindering and search, but is soon thereafter muted by the Officer where the Officers still mentioned the Hindering Arrest if Dustin would not give the Consent Search. Dustin kept saying “No” and tried to explain to the Officers that he was doing nothing wrong, why he was there, and moving. The Officer unmuted the video, and later placed Dustin into his vehicle and Dustin could be heard asking on the video what he was arrested for and the Officer states Hindering, Dustin felt this was punishment for not giving them Consent to Search.
Dustin knew he had the Right to Refuse and to not give a Consent Search, because he was trained at a Police Academy about consent searches. Dustin was really very tired and he was having trouble attempting to remember things as the Police asked their questions, he was taken off guard. It would have been helpful if the Police would have worked with Dustin a little understanding that he was still falling asleep and that he had gone thru allot with his Divorce and Child Custody Battle. This was all very hard on Dustin and his family.
“What I don’t understand is I am a Citizen without a Criminal History whom has served this Country not only in the Military but as a Volunteer to my Community and as a Police Officer, not even making hardly any income at all, and I would have given my life to Protect Another Person and for this Country and how can I be Convicted for Exercising my Right, when does it become a Crime for Exercising Ones Right? If Laws were not there to protect me I simply would not have traveled with my fire arms collection or not owned any.” Dustin Shane Reininger
Dustin was Hand Cuffed to the wall, and was told that Hindering was just a misdemeanor. Dustin offered to make Bail and to be released to continue moving and to pickup his Son from his 1st Ex-Wife, in Texas, from the end of Spring Break, but the Officers would not allow him to make bail, they started ignoring him. Dustin could hear his vehicle being brought into the Police Station Parking Garage next to where he was hand cuffed to the wall. Dustin could also hear someone continuously going out to Dustin’s vehicle thru a Card Reader Security Access Door with Automatic Lock. This type of Security Door System Dustin was familiar with, requires an Identification Card and is Logged in a Computer Software Data Base by a Person’s Name, Date, and Time resulting in a detailed record. With the way the Police Garage was constructed and the Door between the Garage and the Room where Dustin was the noise from the Garage was amplified with the room Dustin was in acting like an Ear Drum. He could hear the distinctive sound of the Auditable Alarm when his vehicle’s Door opened with the Keys in the Ignition. Hours later he could hear his Cell Telephone Ringing, knowing it had to be his Parents worried about him. He could hear his Doors being continuously opened and closed and someone searching his vehicle. This would continue over and over again. Dustin also knew there had to be at least one Security Camera in that garage and he hoped it was pointing at his vehicle for further evidence. Dustin knew he needed to wake himself up even though he had gone for several days without sleep and was still feeling delirious, he continued to hear that Card Reader Door and knew there was a record of it kept on computer software files and later had remembered to ask his Attorney to ask for the Door Record and Camera Video, but the Police Department refused to provide them. Dustin wanted this Door Card Reader Record because the Officers were going in and out of this door and directly to Dustin’s vehicle. Dustin asked for his Phone Call but was not allowed access until later on that evening. As hours passed Officers were telling Dustin they were not sure what to charge him with giving Dustin the impression he would be set free without any charges. When day light hours approached the Police Officers came in with children by him and telling the children Dustin was a bad guy. One of the children even asked “what did he do wrong Daddy”, and one of the Father’s, a Police Officer, stated “we don’t know yet but we will figure something out”. As time went by Dustin could not believe he was in a situation like this. Dustin could still hear the Officers searching his vehicle in the Police Agency’s enclosed garage next to him being handcuffed to the wall. They continued to come and go from the Garage to his vehicle searching all morning and all day. Dustin could not maintain a count because he was so sleepy. Hours later Dustin could hear the Police had opened the Parking Garage Rolling Door and started opening all of the Doors to his vehicle and he could hear the old time flash bulb camera pop as flashes of light announced they were taking photos. Dustin thought to himself why are they taking photos when they have searched his vehicle numerous times already, and removed items, and placed them back into the vehicle and now they were taking photos. Dustin thought to himself they must have a warrant now. Dustin could hear a Deep Throated Voice start giving orders where they could search in the vehicle and where they couldn’t. Dustin thought to himself that the vehicle has to be in such disorder. Dustin thought he would be served with a Search Warrant and Inventory as well, all of which they never provided. Dustin remained hand cuffed to the wall for what appeared to be over 12 hours without food. Dustin learned later that they did obtain a Search Warrant, with the wrong date on it from a Judge and took photos of the vehicle after they had searched the vehicle before the Search Warrant. When we mentioned the Warrant with the wrong date above, this is not the only situation where there were mistakes. There are several situations throughout different hearings and time requirements where procedures were not followed, documents not provided, requests not responded to. On record there is several Letters to the Court where the Prosecutor had explained away reasons that procedure and or time limits were not followed.
They never allowed Dustin the opportunity to bail himself out or contact with a Bail Bonds Company until several days later where they would not allow the Bail Bonds Company to get Dustin’s Credit Cards from his vehicle to setup Bail. Dustin’s Family had to setup Bail for him. When they released Dustin nearly a week later, the Police did not release his Driver’s License and instead gave Dustin his vehicle’s License Plates which was listed on the Property Sheet as “License”. When Dustin went to the Police Department to ask for his Driver’s License and Vehicle the Police served him with more False Firearm Charges than what they arrested him for and they said they never had his Driver’s License and would not release his Vehicle. The next day Dustin spoke with a different Police Supervisor on a different shift that allowed him to receive his vehicle back. Without the Vehicle Dustin had no way of getting back to Texas. A person cannot take a Bus or Flight unless they have Photo Identification, which the Police still said they did not have his Driver's License to return.
When we researched the Readington Township Police Department in New Jersey we saw that the Township has been taken to Court at least 4 times over just the past 5 years for the Police Department in Civil Law Suits, Where the Police Department settled out of Court for an Unknown Dollar Amount.
New Jersey Court
When Dustin traveled to New Jersey for hearings the Judge made a joke which referenced “Texas” & “Shooting from the Hip” using it as an expression and apologized but continued to laugh about it and had the court laughing as well. The Court for a year and a half had Dustin traveling to New Jersey for Court that sometimes where re-scheduled without notice and at times lasting less than 5 minutes. Dustin at first used the Free Public Defender, also known as Court Appointed Attorney whom wouldn’t return Dustin’s calls and wouldn’t file anything with the Court. Instead the Public Defender only wanted to talk to Dustin on how to Plead Guilty and hope for the best offer to a Case he was innocent of. And on one court date Dustin called the Public Defender’s Office to verify that he had court the next day and they confirmed he did, but when Dustin arrived the next day the Court was re-scheduled several weeks prior where Dustin was not notified. Dustin quickly terminated his Public Defender and went with a Professional Law Firm.
As 2010 came along and the months drew closer to a Jury Trial the Prosecutor’s Office started making Dustin offers. With the best offer just a few months prior to the Trial. 90 days in Jail and pleading guilty to 4 Felony Convictions making Dustin a Felon, making a person with no Criminal History a Criminal. A Felon for just moving with his legally owned Firearms. It was either 90 days in Jail to Take the Deal, or 38 Years in Prison to Fight for Your Rights and defend yourself for your Constitutional Rights. Dustin just couldn’t believe it. Dustin constantly thought about his Kids and how he wouldn’t be able to see them again. Dustin also thought about his Parents as they needed him at home in South Texas as their health became worse. Dustin thought about his career being over and how he would have to drop all of his Volunteer Work and other Positions.
As time pressed on Dustin began to lose everything, his first home, vehicles, career, job and business, kids, self respect, and everything else. Dustin to date he has lost more than what he could have being in Jail for 3 months to 38 years and there is no way for him to ever gain it all back, there is no way to replace what he has lost and or even the time with his kids that has been missed. All of this will hurt Dustin’s kids and change their little lives forever. The Internet became full of all kinds of News, Media, and Blog Sites just tearing into Dustin. It was mostly both of Dustin's Ex-Wives writing things on different Blog Sites really trying to destroy Dustin and get back at him for him Divorcing them. It was more so the 2nd Ex-Wife. Prior to Dustin's arrest he was on his way to having custody of his daughter in the Divorce and now he will never see her again for a very long time.
The New Jersey Judge even placed pressure on Dustin to accept the Plea Bargain from the Prosecutor where the Judge stated directly to Dustin and his Attorney in open court, that if Dustin did not accept the Plea Bargain of 90 days in Jail with 4 Felony Convictions then the Judge stated he would have no problem sentencing Dustin to more time in Prison. The Judge gave the court several recesses asking Dustin and his Attorney to go and discuss it, even told the Attorney to talk some sense into Dustin. Still Dustin wasn’t accepting a Plea Bargain because Dustin did nothing wrong. What kind of life and career will Dustin have being a convicted Felon / Criminal.

Prior to and during the New Jersey Jury Trial Dustin’s Attorney pointed out to the Judge, Prosecutor, and Jury different Laws where the Charges against Dustin should be dismissed. The Judge admitted that the Gun Laws are confusing. The Prosecutor even had to refer back to the law book. Even the arresting Police Officer had to consult with his Supervisors and Management. New Jersey Government Memos
A Copy of a Memo was provided Dated Jan. 3, 1991 to all New Jersey Law Enforcement Heads from Robert T. Winter Director of the Division of Criminal Justice New Jersey Dept. of Law and Public Safety Division of Criminal Justice. This states for them to be aware of and follow the US Federal Law Title 18 United States Code Section 926A which allows people to transport their Firearms from State to State for Moving.

Conviction Without Being Present
On August 9, 2010 the New Jersey Court started the Jury Trial without Dustin being present, several days later resulted in dropping many of the charges that he was arrested for, but convicted him of the following charges: Possession of a Rifle (Dustin’s Father’s Childhood Hunting Rifle), Possession of a Shotgun (Dustin’s Grand Father’s Double Barrel Hunting Shot Gun), Possession of High Capacity Magazines (which NJ considers high capacity but allowed in other States), Possession of Hollow Point Bullets (which are used for Hunting so the bullet will not pass thru an animal and hurt someone or property beyond the animal being hunted and still allowed in NJ), and Hindering because Dustin was too sleepy when the Police wanted to question him and search. These are Convictions that Dustin faces for up to 38 years for in Prison. Dustin could Appeal or take other Legal Action but this could take years for Dustin to see Freedom, all the while Dustin has to sit in Prison and wait.
There are numerous rumors to other charges on the internet which is not correct. Even the photos of the Firearms on the Internet are not correct. There is even Internet Sites that claim to show a Statement from Officials about Dustin but when you click on them they have someone else’s name on them and not Dustin’s just to try and make Dustin look worse. This was blown way out of proportion by the Media, but mostly by Dustin’s 2nd Ex-Wife. When the Police called his 2nd Ex-Wife about his arrest she told them that Dustin had tried to kill her, that he was abusive, dangerous, with a long record, and that he was a Gun Runner. Dustin’s 2nd Ex-Wife has made numerous claims against Dustin to gain tactical advantage to Force Child Custody and Divorce that Dustin Filed for back in 2008. Dustin has 3 Court Orders against his 2nd Ex-Wife with one being to not get involved with Dustin’s New Jersey case which his 2nd Wife continued to violate on numerous occasions sending the Police and Prosecutor in New Jersey Faxes and Letters. At some point New Jersey finally realized that Dustin’s 2nd Ex-Wife's claims were false because they never mentioned her in court or in any communication. His 2nd Ex-Wife was the one that had contacted the Media to air prior to Dustin’s Jury Trial that he had left the country and that there was a man hunt which is all not true. Dustin has always passed all Criminal History Checks, Psychological Testing from the Military and from his Career, and Federal Law Enforcement Checks.
We need to point out that all of Dustin’s Firearm Collection was legally transported and owned. All of the Firearms were legally registered as well as legally acquired. One of the charges on Dustin was for a Shot Gun and small caliber Hunting Rifle that New Jersey allows for Sporting and Hunting. Dustin is no Criminal, he is a law abiding citizen, he doesn’t deserve to have his reputation destroyed and or be held as a Criminal for Exercising his Constructional Rights. Dustin has gone thru more Firearm Training from the Military, Government, and his law enforcement career than what most Police Officers would have in their entire career.

When New Jersey convicted Dustin in August 2010 of the above Firearm charges without Dustin even being present the New Jersey Court issued a Warrant for Dustin’s Arrest where the Warrant’s Charges simply reads “Weapon & Assault”, this confused Texas Police into thinking Dustin assaulted someone. So on April 13, 2011 Dustin was arrested for the New Jersey Warrant in Texas. Under the Texas Law, Code of Criminal Procedure, Uniform Extradition Act, there is certain Extradition Laws and Procedures that must be followed. There has been Internet Comments that Dustin faces charges in Texas which is not true. Fact is Dustin was released from New Jersey to his Home State of Texas in 2009 and during Court Proceedings in 2010. While Dustin was awaiting Extradition in Texas, his 2nd Ex-Wife Tactically placed a notice in a Texas paper 5 hours from Dustin, which was supposed to give legal notice that Dustin's Daughter from his 2nd Ex-Wife was being adopted by another Man. The Other Man is the 2nd Ex-Wife's Live in Boy Friend and now Husband that the Daughter had been calling Father for several years now. We guess that Dustin's Daughter is now legally no longer Dustin's Daughter. Now Dustin has lost being a Father and being a Daddy. He will never forget his Daughter, she is still his Daughter and Princess in his heart and memories. Dustin knows she will remember him as she grows up. Her last words were "I will always Love you Daddy". Father is a title that Courts may take from him but Daddy is in the heart of both Dustin and his Daughter and will be there for ever. Dustin's Son is older and understands everything that is going on and for him the title of Father remains and Daddy is there in his heart forever. Dustin was told by a Friend that his Son loves him more than anything in the world and is proud of him, this brought tears to his eyes.
Texas never extradited Dustin to New Jersey, so Dustin ended up turning himself in when New Jersey changed their warrant's title
Dustin was sentenced to serve his time in Mid-State Correctional Facility in Wrightstown , New Jersey.
Dustin’s Father is Crippled at the Knees and can’t get around that well and suffered a Heart Attack in 2010. Dustin’s Mother is Bed Ridden from having several Strokes one in 2010 and another in 2011, has been in and out of the Hospital several times and is being fed thru a Tube. Dustin hopes to be able to return home to his Son, Care for his Parents, some how see his daughter, and hopes to start getting his life back to where he can volunteer again in his community.
